Terms of use
These terms are an agreement between you and goTether Platform, LLC ("goTether," "we," "us") for the Cam Carroll app. By creating an account or using the app, you accept these terms and our privacy policy. If you do not agree, do not use the app.
1. Who can use the app
You must be at least 18 years old. The app is invite-only: you can join only with the email address the team invited, and your role comes with that invite. You are responsible for keeping your login safe and for activity on your account. Tell us right away at support@gotether.app if you think someone else used it.
2. What the app does
The app helps the artist and his team plan music, content, events and goals together. It lets you plan and approve social posts; it does not post to TikTok, Instagram or other services for you. We may change, add or remove features, and we will try to give notice of changes that matter.
3. Your content
You keep ownership of what you add, including songs, voice memos, lyrics, recordings, photos, videos and comments. You give goTether a limited, non-exclusive, royalty-free license to store, copy, process and display that content only to run the app for you and the team you share it with, including backups. This license ends when the content is deleted from the app, except for copies in backups, which are removed on our normal schedule, and content you shared with the team, which stays available to them.
You confirm you have the rights to anything you upload and that it does not break the law or anyone else's rights. Agreements between you and other team members, such as songwriting splits, credits or payment, are between you and them. The app may help you keep track of them, but goTether is not a party to them.
4. Acceptable use
Do not use the app to break the law; harass anyone; upload content you do not have rights to; share malware; try to reach data your role does not allow; probe, scrape or overload the service; or reverse engineer the app except where the law allows it.
5. Our rights
The app, its design and its software belong to goTether and its licensors. The Cam Carroll name, likeness and music belong to the artist. These terms do not give you rights to either beyond using the app as intended.
6. Price
The app is free for invited team members. If we ever add paid features, we will show the price and terms clearly before you agree to pay.
7. Ending your use
You can stop using the app and delete your account at any time. The team's owner can remove your access, and we may suspend or end access if you break these terms or to protect the service or others. Sections 3 (shared content), 5, and 8 through 12 continue after your access ends.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT THE LAW ALLOWS, GOTETHER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. KEEP YOUR OWN COPIES OF IMPORTANT FILES.
9. Limitation of liability
TO THE EXTENT THE LAW ALLOWS, GOTETHER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE APP IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US $100). SOME PLACES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
10. Indemnity
You agree to defend and hold harmless goTether and its officers, employees and agents from claims and costs, including reasonable attorney's fees, that arise from your content, your misuse of the app, or your breach of these terms.
11. Disputes
Louisiana law governs these terms, without regard to conflict of law principles. Any dispute about the app or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Jefferson Parish, Louisiana, or by video. Either side may instead bring an individual claim in small claims court, or ask a court for an injunction to stop misuse of intellectual property.
YOU AND GOTETHER EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
12. App store terms
If you downloaded the app from Apple's App Store: these terms are between you and goTether, not Apple. Apple has no duty to provide maintenance or support for the app. If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. goTether, not Apple, is responsible for handling claims about the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims. You confirm you are not located in a country subject to a U.S. government embargo and are not on a U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you downloaded the app from Google Play, Google's terms for Google Play also apply to your download.
13. General
We may update these terms. If changes are material, we will tell you in the app or by email before they take effect; continuing to use the app afterward means you accept them. If any part of these terms cannot be enforced, the rest stays in effect. These terms and the privacy policy are the whole agreement about the app. Both sides will perform these terms in good faith.
